The User is invited to read these Terms carefully and agrees to accept them before completing a booking through the Website.

These general terms and conditions govern the use and enjoyment of the services offered under the brand 40 Gradi Nord, owned by Great Italian Outdoors LTD, a tour operator registered in the United Kingdom, through the online platform https://www.40gradinord.com. They also govern the relationship between Great Italian Outdoors LTD and the User, providing important information on mutual rights, obligations, and dispute resolution methods.

The User agrees to accept these Terms by any of the following actions:

• — “User Account” — profile created by the User upon registration on the Website
• — “Listing” — section of the Website describing the various types of services offered
• — “Partner” — person or company providing services listed on the Website
• — “Tour Price” — total cost due from the User to 40 Gradi Nord for the selected service
• — “User” — individual or legal entity requesting the booking of a Service through the Website

Upon registration, the User agrees to:

• — Provide accurate and complete information and keep it up to date
• — Safeguard their User ID and Password and prevent unauthorised use
• — Promptly notify 40 Gradi Nord of any unauthorised access to their credentials
• — Hold 40 Gradi Nord harmless from any damage arising from a breach of the above

40 Gradi Nord reserves the right to suspend or deactivate a User’s account at its sole discretion if it determines that the User’s conduct may cause harm to 40 Gradi Nord or third parties.

To book an activity, simply select one of the featured options from the Website’s Home Page, visit the activity page, and click the “Book Now” button.

On the next screen you can select the number of participants and desired dates. Once the activity is chosen, payment can be completed from the cart page via credit/debit card, bank transfer, or other available methods.

Upon completing a booking, the User consents to receiving a confirmation email summarising the purchased service and authorising the related payment.

Users may request changes to their booking — such as number of participants or itinerary — up to 7 days before the start of the activity. 40 Gradi Nord will respond by email or phone, indicating any applicable price adjustment.

If rescheduling or modifying the activity is not possible, the User may request a Cancellation.

All cancellations and amendments must be sent to info@greatitalianoutdoors.com, quoting the name and booking reference from the confirmation email.

In the event of bad weather, sudden equipment failure, or guide illness, the User may request a reschedule or a refund. Only the administrative processing fee of 1.4% of the total will be charged.

40 Gradi Nord shall not be liable for any refund in the event of cancellations caused by Force Majeure (extraordinary events, airport closures, serious illness, natural disasters, fires, military action, hurricanes, adverse weather conditions, etc.).

If the User is unable to use the Service due to Force Majeure, 40 Gradi Nord reserves the right to refund the User the applicable amount at its discretion.

Should it become necessary to modify an itinerary or the dates of an activity, 40 Gradi Nord will promptly contact the User with an updated plan. If the User is not satisfied with the proposed changes, they may request an alternative or a full refund.

A. Age Requirement

Services are NOT intended for unaccompanied minors under 18 years of age. By accepting these Terms, the User declares they are of legal age and have the legal capacity to book the Services. 40 Gradi Nord accepts no liability for false declarations made by the User regarding their age.

B. Disclaimer of Liability

To the fullest extent permitted by law, 40 Gradi Nord shall not be held liable for:

• — Punitive, special, indirect, or consequential losses or damages of any kind
• — Inaccurate or inadequate service descriptions provided by a Partner
• — Services rendered or products offered by Partners
• — Damages arising from Website malfunctions, delays, or unavailability
• — Physical injury, death, or property damage attributable to services provided by Partners

C. Electronic Communications

The User acknowledges that the Service relies on electronic communication networks operated by third parties. 40 Gradi Nord is not responsible for interruptions or malfunctions of such networks. Service availability may be subject to technical limitations or outages without prior notice.

D. Network Operations

40 Gradi Nord disclaims all liability for damages caused by computer viruses, corrupted files, errors, software/hardware incompatibilities, or unauthorised access. 40 Gradi Nord does not guarantee uninterrupted, secure, or error-free service delivery.

E. Complaints & Disputes

Any complaint regarding the performance of this contract must be submitted within 10 days of the service date to info@greatitalianoutdoors.com or by registered post to: M.01 Tomorrow, Blue, Media City UK, Salford M50 2AB, United Kingdom.

F. Personal Use of Content

40 Gradi Nord grants permission to use Website content for strictly personal and non-commercial purposes only. Reselling, copying, deep-linking, scraping, downloading, or reproducing any content for commercial or competitive purposes is strictly prohibited.

G. General Area Information

40 Gradi Nord may provide information about local accommodation, other tours, or activities. Such third-party services are not part of the contract; 40 Gradi Nord accepts no responsibility for activities not under its direct supervision.

40 Gradi Nord strongly recommends that all clients purchase adequate insurance covering all chosen activities. Note that many insurers do not cover activities deemed hazardous. Recommended providers include:

It is the User’s responsibility to ensure their policy covers the activities undertaken. Users are advised to carry a copy of their policy at all times.

The Website may contain links to third-party websites not operated by 40 Gradi Nord. 40 Gradi Nord accepts no responsibility for their content, particularly with regard to information security. Users are advised to use appropriate antivirus protection and review the relevant privacy policies.

Each linked site maintains its own independent privacy policy. Should 40 Gradi Nord receive reports of unreliable or unlawful linked sites, it may, at its sole discretion, remove the relevant link.

By publishing content on 40 Gradi Nord’s channels, the User agrees to grant, free of charge, all rights arising from the use of their reviews, photos, and videos, including images in which they appear, in accordance with applicable copyright law.

Published content may be freely read, republished, translated, and distributed through any medium — including third-party advertising and promotional activities — without requiring further authorisation.

These General Terms are governed in their entirety by Italian law. The original Italian-language text is legally binding; any translations are for informational purposes only.

The competent court shall be that of the User-consumer’s place of residence. Where the User does not qualify as a consumer under applicable Italian law (d.lgs. 206/2005), exclusive jurisdiction shall vest in the Court of Cagliari.

40 Gradi Nord may amend these Terms at any time at its sole discretion. Users are invited to review the Terms before each booking. Amendments will not apply to bookings already confirmed at the time of the change.
